As legal fights continue over other portions of DOMA, involving gay military service members, attorneys for the House GOP-led Bipartisan Legal Advisory Group filed a legal brief declaring it will no longer be a party defendent for the law.
"While the question of whether 38 U.S.C. § 101(3), (31) is constitutional remains open," read the brief, "the House has determined, in light of the Supreme Court’s opinion in Windsor, that it no longer will defend that statute. Accordingly, the House now seeks leave to withdraw as a party defendant."
Wow, sometimes they do know when to throw in the towel. I'd call this a strategic retreat, but clearly this specific instance is just a tactical component of the overall admission that they've lost on this issue.
