"No State shall..."

So SC ratified the 14th Amendment on this date in 1868, making it a part of the Constitution after quite an ugly process.  And things only got uglier, as Justice Black complained in 1938:

[O]f the cases in this Court in which the Fourteenth Amendment was applied during the first fifty years after its adoption, less than one-half of 1 per cent. invoked it in protection of the negro race, and more than 50 per cent. asked that its benefits be extended to corporations. 

So long as we have our priorities straight today...

Ah, so Scalia was following precedent when he applied the 14th to GOP ballots.

Why didn't those 19th century dudes include a "not for application to humans" warning label on the 14th?
