File Under 'No Duh'

But I thought it wasn't a suicide pact:

The Supreme Court ruled Thursday that foreign terrorism suspects held at Guantanamo Bay have rights under the Constitution to challenge their detention in U.S. civilian courts.

In its third rebuke of the Bush administration's treatment of prisoners, the court ruled 5-4 that the government is violating the rights of prisoners being held indefinitely and without charges at the U.S. naval base in Cuba. The court's liberal justices were in the majority.

Justice Anthony Kennedy, writing for the court, said, "The laws and Constitution are designed to survive, and remain in force, in extraordinary times."

The reason we have a Constitution to remind us we all have rights all the time, not when it's convenient.  The whole point is to establish foundations of a free society, not grant the government license to do whatever it wants.  We are supposed to enjoy the protections of the rule of law, not be at the mercy of capricious whims of the moment.

That 5-4 decision is the hallmark of a very fragile court. That those 4 stooges dissented in the name of something that is totally not in keeping with strict constructionism (whatever that means) scares me into working my ass off for Obama.
